The Punjab and Haryana High Court on 30 October 2026 set aside a decision deferring Mukesh’s premature-release case and ordered fresh consideration within four weeks of receipt of the certified order.

In CRWP-12097-2026 (2026:PHHC:194846), the Court required Haryana to apply its governing policy consistently. The seriousness of the original offence did not justify arbitrary differentiation between similarly situated convicts. Prison conduct, rehabilitation and other relevant circumstances must inform the decision. The order does not itself grant release.
