The Supreme Court has granted anticipatory bail to Sudhansu Sekhar Rout in a Bhubaneswar case, holding that unrelated criminal antecedents could not by themselves justify custodial arrest.
Rout faced allegations under Sections 353, 196 and 356 of the Bharatiya Nyaya Sanhita. He had joined the investigation, while Odisha relied on multiple previous cases and witness statements to oppose protection.
The Court found that the Section 196 allegation might not be established on a prima facie reading of the FIR. It concluded that the remaining charges did not require custodial interrogation.
The assessment is confined to bail and cannot influence the trial. Rout must cooperate with the investigation and comply with conditions fixed by the trial court. The order separates genuine investigative need from punishment based merely on a person’s past record.
