In a judgment that reads like a firm nod to journalistic spine, the Delhi High Court has swept aside a decade-old criminal defamation case against journalist Nilanjana Bhowmick, declaring that truthful reporting cannot be twisted into wrongdoing simply because someone finds it unflattering.
The story traces back to Bhowmick’s 2010 piece for an international magazine, a report examining financial scrutiny of Indian nonprofits. Activist Ravi Nair—whose organisation appeared in that article—took offense in 2014, claiming the writeup suggested involvement in money laundering.
The Court, however, saw the matter with far more clarity.
Justice Neena Bansal Krishna noted that the article simply stated a fact: a complaint had been lodged against Nair’s NGO, prompted by a European agency’s tip-off. That discomfort, the Court held, did not magically transform truthful reportage into defamation.
The judge was unequivocal—presentation style may vary from writer to writer, but as long as the core facts are correct, the law of defamation has no quarrel with journalism. Attempts to stretch “innuendo” or “insinuation” into a criminal allegation, the Court said, reflect oversensitivity, not defamation.
In two crisp lines, the Court dismantled the complaint: nothing in the article was factually wrong; nothing met the legal threshold for defamation.
There was another fatal flaw in the case—the clock had run out. Since the article was first published in 2010 and the complaint arrived four years later, the Court held that the prosecution was time-barred. Continued online availability, it clarified, doesn’t reboot the limitation period.
With that, the Court discharged Bhowmick entirely and quashed the proceedings, shutting the door on a case that lingered far too long after the facts had already spoken for themselves.
