The Supreme Court has dismissed a fuel dealer’s challenge after it failed to deposit ₹80 lakh required by an earlier conditional stay.
The Court had protected the petitioners from operation of a Bombay High Court order only if the sum was deposited within two weeks. Nothing was paid. At a later hearing, the petitioners disputed the amount, while the respondent maintained that roughly ₹1.75 crore remained due.
The Court held that non-compliance left no basis to continue the proceedings and dismissed the special leave petition. Its order underscores that interim protection tied to a clear condition is not open-ended: a party cannot retain the benefit of a stay while ignoring the obligation that triggered it.
The dismissal did not adjudicate the competing calculations of liability. It rested on the petitioners’ failure to meet the Supreme Court’s own deposit requirement.
