Mumbai’s air has once again slipped into its familiar autumn gloom, prompting the Bombay High Court to step back into the fray with a tone that suggested both impatience and inevitability. The judges, weary of déjà vu, remarked that the city’s seasonal pollution spike has become less of an aberration and more of a ritual—an annual smoke signal that warnings are going unheeded.

What began as a suo motu case in 2023 resurfaced with urgency as the Bench reviewed the latest compliance notes from various civic bodies. The judges found a familiar pattern: detailed rules on paper, a scattered patchwork of on-ground efforts, and a whole lot of construction dust swirling freely through the city’s autumn breeze.

Frustrated by recurring lapses, the Court assembled a four-member inspection group—drawing from forest expertise and legal oversight—to trace the city’s dirtiest pockets. With assistance from the municipal corporation and the state pollution board, this team has been tasked with mapping emission hotspots, checking construction sites, and auditing industrial units against the city’s 27-point dust-control checklist. Tarpaulin covers, water sprinklers, air-quality sensors—tools meant to tame rising dust—have, the Court noted, been treated more like suggestions than requirements.

During the hearing, the amicus curiae pointed to reports showing enforcement squads doing little more than symbolic rounds. He also highlighted research suggesting that more than half of Mumbai’s pollution load comes from construction activity and road dust alone.

The Court has now ordered swift updates: a concise status report from the inspection committee, and detailed affidavits from both the municipal corporation and the pollution control board outlining what they plan to fix—immediately and in the long run. The message was unmistakable: the city cannot continue to choke while guidelines gather dust instead of controlling it.
